MiMedx subpoenaed for sales and marketing practices

The Office of the Inspector General of the Department of Health and Human Services issued a subpoena to MiMedx in connection with a civil investigation related to the company's sales and marketing activities.

Around 18 months ago, the company identified a compliance policy violation and terminated that individual within 24 hours.

 

"I can assure you that the corporate officers at MiMedx are not aware of anything that would stimulate this investigation," said Chairman and CEO Parker Petit. "We have continually maintained and improved a robust compliance program. We have been very focused on the thoroughness of our compliance policies and our staff adhering to these policies."

 

MiMedx plans to fully cooperate with the investigation, according to a news release from the company, and hopes to expedite the process. The company already began producing responsive documents and no proceedings known to the company have been initiated at this time.

 

There have been investigations in the wound care market over the past few years, including one focused on Advanced BioHealing's sales and marketing practices.

 

"We anticipated that the ABH investigation could lead to a review of other industry participants, particularly in view of the fact that several industry participants, including MiMedx and some of our competitors, have hired former ABH employees," said Mr. Petit. "We screen all of our applicants very carefully."

 

While Mr. Petit expects any investigation will confirm the strength of the company's compliance policies, he said steps will be taken to address any issues and ensure future compliance.

 

The company also announced filing a lawsuit today against competitor Organogenesis for interfering with a contractual relationship with healthcare providers.
