Treace Medical, Fusion Orthopedics reach agreement in patent dispute

Foot and ankle device company Fusion Orthopedics has reached an agreement with medical device company Treace Medical in an ongoing patent dispute. 

In March 2022, Treace filed a civil action suit against Fusion in an Arizona district court, alleging patent, trademark and copyright infringement, according to a March 2 press release. 

Treace also accused Fusion of unfair trade practices based on Fusion's use, sale and promotion of the Lapilock 4D Advanced Bunion Surgery, alleging Fusion was using false advertising and creating unfair competition. 

Fusion Orthopedics filed counterclaims, claiming Treace's Lapiplasty trademark was invalid. Fusion also accused Treace of unfair trade practice based on the use, sale and promotion of the Lapiplasty Bunion Correction. 

The two parties have entered into an agreement to settle the dispute. Terms of the settlement are confidential.
