In November 2019, the Moskowitz Family, which holds spinal fusion implant patents, sued Globus Medical alleging direct and indirect infringement. A jury in December 2023 ruled that the Moskowitz Family didn’t meet “burden of proving, by a preponderance of the evidence, infringement by certain of [Globus Medical’s] accused products of specified claims” for the three patents in its lawsuit.
The Moskowitz Family’s motion for a new trial was denied. An order said that jurors followed instructions properly and there wasn’t “indication that the jury misunderstood the law.”
A spokesperson for Globus Medical didn’t provide comment on the pending litigation.
