Here are two developments in spine-related lawsuits in July.
1. Denver-based AdventHealth Porter was ordered to pay a spine surgery patient almost $3.2 million after he accused employees of dropping him after surgery. The 82-year-old man filed his lawsuit in Denver District Court, alleging he was dropped when staff tried moving him from a CT scanner platform to a bed, the report said. He had a spinal fusion at the hospital in March 2024 and filed his lawsuit in February. A jury made their ruling in the case on July 18.
2. A federal district court dismissed a lawsuit from a New Jersey spine practice accusing Blue Cross Blue Shield of Illinois of violating the No Surprises Act. Prime Neuro Spine Institute in Montville, N.J., filed the lawsuit seeking confirmation of seven Independent Dispute Resolution determinations and alleging No Surprises Act violations following a conflict over a 2023 spine surgery. The practice submitted a claim to BCBSIL seeking payment, and the insurer remitted $71,941.25. However the court determined there wasn’t any evidence BCBSIL deliberately targeted the practice’s protections and benefits establishing jurisdiction.
