Smith & Nephew had purchased the wipes and other products from Triad, but the company now claims Triad didn’t “exercise ordinary care to prevent any defective condition,” according to the lawsuit. Smith & Nephew also maintains it has spent money defending claims related to Triad products.

The wipes were recalled because the FDA found some were contaminated with Bacillus cereus.
