Here are five things to know:
1. The United States District Court for the Southern District of California jury found Arthrex infringed on KFx’s patent for an orthopedic device. KFx was awarded $29 million in damages.
2. In April, the U.S. Court of Appeals reaffirmed the January 2015 ruling, upholding the previous decision and denied Arthrex’s petition for en banc rehearing and issued a mandate to enforce the judgment.
3. KFx originally filed the complaint against Arthrex in 2011. KFx licensed its ‘311 family of patents to Johnson and Johnson and Smith & Nephew.
4. KFx Medical focuses on sports medicine procedures. W. Tate Scott is the chairman, president and CEO of the company. He has more than 30 years of experience in drugs, devices and combination products at American Hospital Supply and Johnson and Johnson.
5. Arthrex recently paid $95 million to Smith & Nephew for patent infringement.
