Could the medical device excise tax actually go away in the tax cuts package? 5 key notes

There is renewed hope that Congress will suspend the 2.3 percent medical device excise tax, implemented as part of the ACA, according to a Journal Gazette report.

Here are five key notes:

 

1. Congress is expected to vote on a package that includes suspending the medical device excise tax on Thursday or Friday of this week.

 

2. Medical device trade groups endorsed the provision, which is designed to extend expiring tax cuts and includes the medical device excise tax elimination.

 

3. The House of Representatives voted to repeal the tax in June 2015, but the Senate hasn’t considered the measure, which helps fund the ACA.

 

4. The current legislation package has a Jan. 1, 2016 deadline for renewing various expiring tax credits. However, the package has many provisions and could draw opposition from lawmakers that would otherwise vote to suspend the device tax.

 

5. Eliminating the medical device excise tax has been a top priority for representatives from states like Indiana where a high volume of medical device companies, including orthopedics companies, are located. President Barack Obama indicated he would sign a tax-breaks package approved by Congress into law.
