Orthopedic Systems, which agreed to pay Dr. Schlein 5 percent of the proceeds from his invention — the Schlein Shoulder Positioner — stopped making payments in 2005. Since then, a judge has awarded Dr. Schlein $616,000 in lost royalties and ruled that he was entitled to a percentage of the company’s proceeds from the device.
Orthopedic Systems appealed, but the court rejected the appeal.
