Wisconsin Spine Surgeon Challenges Hospital Employer’s Non-Compete Clause

Branko Prpa, MD, a spine surgeon in Racine County, Wis., is awaiting a ruling on a lawsuit he filed against Wheaton Franciscan Medical Group challenging its non-compete clause, according to The Journal Times.

Dr. Prpa is leaving Wheaton Franciscan in mid-August, and filed a lawsuit last May challenging the hospital’s restrictions preventing physicians who leave the facility from practicing medicine in Racine County for up to 18 months, according to the report.

A basis for Dr. Prpa’s challenge is the clause restricts him from providing any medical or surgical services during that period even though he was contracted to just perform orthopedic spinal surgery.
