Members of Congress Trying to Remove In-Office Imaging as Stark Self-Referral Ancillary Exception

Two members of the House Energy & Commerce Committee are attempting remove advanced imaging services from the current in-office ancillary exception to the Stark self-referral law, according to several news sources.

Reps. Anthony Weiner (D-N.Y.) and Bruce Braley (D-Iowa) are supporting HR 2962, which was introduced by Jackie Speier (D-Calif.), that would close an in-office “loophole” to the self-referral law that would exclude advanced imaging, such as MRI, CT and PET scans, according to the American Urological Association Government Relations & Advocacy Department and the American College of Radiology.

The changes are expected to be introduced as an amendment during the House Energy & Commerce Committee’s mark-up of HR 3200, the America’s Affordable Health Choices Act of 2009.
