Athrex Wins Current Round of Smith & Nephew’s Patent Challenge of Its SutureTak or PushLock Products

Arthrex has won the current round of a legal battle with Smith & Nephew over patent rights to Athrex’s SutureTak or PushLock products, according to a report by the Naples News.

Specifically, Arthrex won an appeal in federal court over a patent infringement lawsuit filed by Smith & Nephew, reversing a $23 million judgment made last year.

The case will now be sent back for a new trial, a Smith & Nephew representative told the newspaper.

Smith & Nephew claims that the Athrex products infringe on its patents for Tag Wedge, Tag Rod and Bioraptor.
