2nd protest filed over Western Kentucky University's sports medicine complex project: 8 notes

A second protest was filed by Western Kentucky Orthopaedic and Neurosurgical Associates over a proposed sports medicine complex built through a partnership with Western Kentucky University and The Medical Center, the Bowling Green Daily News reports.

Here's what you should know.

 

1. WKU and The Medical Center entered into a partnership to build a $22 million sports medicine complex on campus.

 

WKONA is alleging that the project violated regulatory and procurement laws. It also took issue with a clause that awarded WKU employees for using The Medical Center as their healthcare provider.

 

2. WKONA is filing a second protest over "issues" despite WKU saying it would follow the advice of state lawmakers and issue a request for proposal.

 

3. Attorney for WKONA Jonathan Miller said the filed RFP is "an attempt to formalize something that has already been agreed to under the guise of competitive procedures, which really undermines the whole process of procurement."

 

4. The university rejected a previous protest by WKONA and said it would be moving forward with its RFP.

 

5. The Medical Center maintains its compliance with state and federal laws, and plans to submit a formal bid.

 

6. The Medical Center was originally going to gift the complex to WKU. Through gifting the complex, WKU wouldn't have to issue a RFP.

 

7. State lawmakers tabled a review of the deal, and in turn WKU said it would start a formal bidding process.

 

8. Mr. Miller is arguing that the agreement would create a monopoly in the area.
