The lawsuit, filed in Delaware District Court, alleges that NuVasive is selling spinal screws that infringe up to eight of the surgeon’s patents.
Dr. Jackson, of North Kansas City, Mo.-based Spine & Scoliosis Surgery, is seeking cash compensation and a court order blocking “further unauthorized use” of his inventions, according to the report.
Since 2013, NuVasive has paid Dr. Jackson millions of dollars in royalty and license fees. In 2015, NuVasive paid him more than $30 million in royalties, according to CMS’ open payments database.
In 2013, Dr. Jackson won a $12.2 million judgement in a case alleging nonpayment of royalties by a Japanese-based orthopedics company regarding the “Jackson table,” which helps position patients for spine surgery.
