A jury sided against a spine surgeon in his contract dispute with Johnstown, Colo.-based Nadora Healthcare.
Fernando Techy, MD, sued Nadora, formerly Arete Surgical Centers, in 2022 alleging breach of contract. He joined the surgery center in 2014 and bought five units of the company, the lawsuit said. Dr. Techy agreed to a buyback of his shares after a series of legal disputes, and the surgery center was to pay him $75,000 if he worked there through 2021.
Dr. Techy’s lawsuit said that the surgery center refused to pay, but Arete claimed he stopped performing procedures sooner than the agreed time, Law360 reported Sept. 19.
Dr. Techy moved to work in Texas before the first of three $25,000 payments was due, the report said.
The jury verdict in favor of the surgery center was filed Sept. 18. A judge issued a final judgement the next day awarding $300,586 to the center, Law360 reported.
Representatives for both parties didn’t respond to requests for comment from Law360. An attorney for Dr. Techy didn’t immediately respond to Becker’s Sept. 22 request for comment.
