Deloitte on the hook for improperly reimbursing for spinal surgery, judge rules

A judge for the District Court of New Jersey has denied a motion from Deloitte to dismiss a claim filed against the company by the Atlantic Spine Center in West Orange, N.J.

In 2020, Atlantic Spine performed lumbar spine surgery on a patient insured under one of Deloitte’s health and welfare benefits plans.

Following the procedure, Atlantic Spine sent claim forms to Deloitte on or about July 26, 2020, requesting reimbursement of the surgical services provided to the patient in the amount of $160,000, according to Nov. 5 court documents.

Deloitte reimbursed the practice in the amount of  $4,106.10. Atlantic Spine went through Deloitte’s internal appeals process to receive the rest of the money. 

The practice then filed legal action against the insurer in February 2023, after which Deloitte filed a motion to dismiss the complaint in April 2023. 

Deloitte has since filed several motions to dismiss the case, which have been repeatedly denied.
