The hip implant settlement is for cases filed in the MDL 2768 in Massachusetts, MCL 624 consolidated proceedings in New Jersey and other jurisdiction for cases already and pending.
Terms of the settlement were not disclosed. Settlement amounts will vary and criteria for the amounts will be based on various factors, including degree of harm and components which need to be removed.
While this settlement addresses many of the cases brought against Stryker’s LFIT V40 hip implant, it does not settle all filed claims. The settlement addresses the first cases in the Bellwether trials, and discovery will continue through 2019.
Eligibility of the failed implants for the settlement include those that were recalled and unrecalled cobalt chromium V40 heads and compatible stem system configurations.
