Liability Lawsuit Against Stryker Dismissed

The U.S. Court of Appeals for the Fifth Circuit has upheld a lower court’s decision to dismiss a product liability lawsuit against Stryker over the now-recalled Trident hip implant, according to a Mass Device new report.

The decision follows the 2008 U.S. Supreme Court ruling in Riegel vs. Medtronic, stating that the FDA 510(k) approval of a medical device preempts state law, and product liability lawsuits based on state tort laws have no standing, according to the report.

Stryker has won previous lawsuits regarding the Trident hip implant.
