The former employee was sued in U.S. District Court for the District of Massachusetts for multiple claims, including breach of contract. NuVasive accused him of doing business with former customers on behalf of his new employer, violating noncompete and nonsolicitation obligations.
The court ordered him to pay more than $1.7 million in damages and attorney fees.
The former employee appealed the verdict, arguing that the court failed to establish the connections between his conduct and specific damages to the company. But an appeals court found “no clear error in the amount of or methodology for determining damages awarded,” the report said.
