Zimmer Biomet filed a lawsuit against Deloitte, accusing the consulting firm of mismanaging a resource planning software system.
The lawsuit was filed Sept. 4 in New York Supreme Court for New York County, according to Law.com. Zimmer Biomet alleged that Deloitte “misrepresented its capabilities, assigned incompetent personnel and concealed system defects” before the $94 million software system went live in July 2024.
Zimmer Biomet alleges that issues with the software led to “massive disruptions” to the company’s operations and supply chain management. The medtech company is suing for $172 million in damages.
“While litigation is never our first choice, Deloitte strung us along with repeated false assurances, both before the contract and before the system go-live,” Zimmer Biomet General Counsel, Chad Phipps, said in an emailed statement to Becker’s. “This is not the conduct we expect nor tolerate from our business partners, and we intend to hold Deloitte accountable for its actions, which not only seriously disrupted our business, but also put patient care at risk.”
“We are deeply committed to our clients, regret that Zimmer Biomet has chosen to embark on this path, and will defend ourselves vigorously against this meritless claim,” a spokesperson for Deloitte told Becker’s in a Sept. 9 email.
