Shaun Kink, MD, is seeking to have his charges dropped because a Bloomington police detective allegedly lied to a grand jury that returned the indictments, the report said.
Dr. Kink was charged in January 2020 with aggravated criminal sexual assault and sexual abuse of a patient. He admitted to the encounter in October 2021 but claimed it was consensual.
Detective Jeff Engle interviewed Dr. Kink on Jan. 1, 2020. Dr. Kink didn’t answer questions and asked for a lawyer when asked about his contact with the patient, the report said. However, in a testimony, Mr. Engle told jurors Dr. Kink denied contact with the victim outside of medical appointments at his former workplace, Bloomington, Ill.-based McLean County Orthopedics.
Mr. Engle also gave misleading information to jurors about other details in the case, including what Dr. Kink was wearing and the nature of the patient’s disability.
A hearing is scheduled July 8.
