Northern Arizona Orthopedics sued for alleged gender discrimination, retaliation

Northern Arizona Orthopedics in Flagstaff was sued by a federal agency over alleged gender discrimination and retaliation.

The U.S. Equal Employment Opportunity Commission accused NAO of refusing to hire male applicants because of their gender and retaliating against a male candidate who complained about the alleged discrimination.

The lawsuit, which was filed on Sept. 4, alleges that NAO hired women over more-qualified male candidates for at least two positions. NAO allegedly discouraged a male applicant who complained about it from applying for other positions, which would violate Title VII of the Civil Rights Act of 1964.

The EEOC's lawsuit seeks back pay, compensatory damages and punitive damages for qualified male applicants, as well as measures to prevent future discrimination. The agency tried to reach a settlement with NAO through its pre-litigation conciliation process before filing suit.

NAO's practice manager could not be reached for comment at the time of publication.
