Malpractice Lawsuits: 6 Statistics on Physician Time Spent in Defense Preparation

Twenty-eight percent of physicians spent more than 40 hours on defense preparation before trial when faced with a malpractice lawsuit, according to Medscape’s Malpractice Report, released in 2013.

Researchers polled 3,480 U.S. physicians from across 25 specialty areas for the survey.

When asked how long they spent preparing their defense, respondents reported the following:

•    One to five hours — 11 percent
•    Six to 10 hours — 15 percent
•    11 to 20 hours — 15 percent
•    21 to 30 hours — 11 percent
•    31 to 40 hours — 8 percent
•    More than 40 hours — 28 percent
