Anthem's spinal surgery settlement notifications not adequate

Practice Management

Anthem will need to come up with a new way to notify patients of a class action settlement over spinal surgeries, according to Bloomberg Law.

Back in November 2018, Anthem settled a lawsuit and agreed to pay up to $35,000 per affected patients, according to Bloomberg Law. The lawsuit claimed the insurer failed to cover new spinal surgeries to treat neck and arm pain.

After not covering two-level cervical artificial disc replacement surgery, Anthem agreed to reimburse qualifying patients who paid out of pocket for the surgery.

Anthem planned to notify nearly 200 qualifying patients through basic fist class mail. However, a U.S. District Court judge said Anthem must use at least priority mail flat rate envelopes that are marked with "attention-getting text," according to Bloomberg Law.
