U.S. appeals court upholds $35M patent infringement & validity judgment against Arthrex

The U.S. Court of Appeals for the Federal Circuit upheld a judgment of the U.S. District Court for the Southern District of California stating that Arthrex infringed three patents that KFx Medical possessed.

The judgment also found that the patents were valid, and awarded KFx Medical $29 million in damages. The District Court judge later awarded additional damages and interest, bringing the total judgment to over $35 million.

 

In 2011, KFx filed a complaint against Arthrex alleging claims of induced and contributory infringement of United States Patent Number 7,585,311. Previously, KFx had licensed the '311' family of patents to Johnson and Johnson and Smith & Nephew.

 

KFx Medical develops products for tissue fixation in numerous orthopedic surgical procedures of the shoulder, knee, foot and ankle.
