Chillicothe, Ohio-based Adena Health and Brian Cohen, MD, Aaron Roberts, MD, and Troy Thompson, DO, reached a resolution after years of litigation.
Adena Health filed a lawsuit in 2021 against the three former orthopedic surgeons, alleging breach of contract, breach of the duty of loyalty, tortious interference, trade secret violations and civil conspiracy. Adena accused the physicians of misappropriating physician productivity data, private economic data, pay information and business plans for its orthopedic surgery group, and of trying to persuade other Adena physicians to leave the system. The physicians had submitted their resignations with 120 days’ notice but were terminated weeks later. Adena sought up to $125,000 in damages.
The physicians denied the allegations and filed a countersuit, alleging Adena retaliated against them, breached their employment contracts, slandered them and violated antitrust laws.
The parties reached a settlement, according to an Aug. 1 news release from Adena. The terms of the settlement were not disclosed.
“All parties are thankful to move beyond this chapter in a responsible way that keeps the well-being of the community at the center,” Adena Health said.
