A New York judge denied an appeal by spine surgeon Joseph Weinstein, DO, to see worker’s compensation patients, Newsday reported March 10.
The decision stems from an initial ruling to bar Dr. Weinstein from seeing patients with workers’ compensation claims in 2025. His renewal application with the New York State Workers’ Compensation Board was rejected after he was among several orthopedic surgeons named in a racketeering lawsuit alleging false accident claims.
Schenectady County Supreme Court Justice Thomas Buchanan ruled that Dr. Weinstein failed to prove that the board was biased because of his connection to the lawsuit, the report said.
Dr. Weinstein’s attorney and a board spokesperson didn’t provide comment to Newsday.
