Life Spine owes Globus Medical $9.5 million for infringing a patent related to parts used in expandable spinal fusion devices, Law 360 reported Aug. 15.
The jury ruling stems from a 2021 lawsuit that Globus Medical filed in Delaware District Court. Globus Medical alleged that Life Spine’s ProLift products infringed its Caliber line of expandable intervertebral implants.
A jury ruled that Globus Medical was entitled to $6 million in lost profit damages and $3.5 million in reasonable royalty damages for infringement of U.S. Patent No. 8,845,731.
“We are pleased with the jury’s decision, which affirms the strength of our intellectual property and the groundbreaking innovation behind our expandable implant technologies,” Keith Pfeil, Globus Medical CEO, said in an August. 28 news release. “This verdict underscores Globus’s place as a leading innovator in the musculoskeletal field.”
Globus Medical has a separate patent infringement litigation pending with another company that involves its expandable implant and retractor technology.
