J&J subsidiaries slammed with lawsuit related to hip replacement product failure: 7 key notes

A patient is filing a lawsuit against DePuy Orthopedics and other subsidiaries of Johnson & Johnson for an alleged hip replacement product failure, according to a Penn Record report.

Here are seven key notes:

1. The patient, Anthony Kinard, is suing DePuy Orthopedics; Depuy (in Delaware); Johnson & Johnson International (Delaware); and Johnson & Johnson (New Jersey) in the U.S. District Court for the Eastern District of Pennsylvania.

 

2. The lawsuit is claiming negligence and damages for a 2007 procedure in which the hip replacement device was found to be defective, allegedly.

 

3. According to the suit, the device — the Acetabular System — was recalled in 2010.

 

4. The suit states that the patient required revision surgery in September and October 2014.

 

5. Mr. Kinard claims that product caused injuries, including metal poisoning as well as lost wages.

 

6. The lawsuit also alleges that the product was marketed without sufficient testing and aggressively promoted by the defendants.

 

7. Mr. Kinard is seeking monetary damages of more than $75,000, punitive damages, attorney's fees, prejudgment interest and court costs, according to report.
