Texas Court Rules Zimmer's Implant-Specific Instruments Fall Under Tax Exemption

Spinal Tech

A Texas court of appeals recently ruled that Zimmer's specialized instruments are exempt from sales and use taxes under the current tax code, according to a Ryan news release. In the most recent case, Zimmer US, Inc. v. Combs, Zimmer demonstrated that its s instruments designed solely for use with Zimmer implants were exempt under the tax code's "orthopedic appliance" exemption. The court made the decision in favor of Zimmer's surgical instruments because they were designed specifically for orthopedic surgeries.

It is currently unknown whether additional appeals will be sought.
