Emerge Medical CEO John Marotta, who previously served as a sales representative for Synthes, recently filed a counterclaim against Synthes alleging antitrust violations, according to a Mass Device report.
Synthes filed a suit against Mr. Marotta and others, alleging their work with Emerge Medical, a generic orthopedic device company, violated non-compete agreements. Mr. Marotta resigned from Synthes in 2010, saying he would join a non-competitor, but Synthes says Emerge Medical's cheaper generic devices compete with Synthes.
The counterclaim alleges that Synthes violated antitrust statutes and sent letters to Emerge Medical customers with misleading information, according to the report.
